The Clarity Act failed cloture — the probability was right, the roll call is the story

On 2026-09-15 the Senate declined to advance the Digital Asset Market Clarity Act: the cloture vote fell about eleven short of the sixty needed, with reports of the exact tally differing (CoinDesk 49–50; others 50–49) and several Republicans among the no votes. The fact that will matter longer is who voted no: seven Democrats who had spent months negotiating the bill — Gillibrand, Warner, Booker, Warnock, Gallego, Alsobrooks, Cortez Masto — turned against it over ethics provisions on officials' and relatives' crypto holdings. The House passed the bill in 2025; this is the Senate's second stall; Senator Lummis said "we're done, it's over" after 120-plus changes. Why

Two kinds of failure look identical on a scoreboard. A bill that falls short because the whip count was optimistic is a bill that comes back with three more phone calls. What the bill was

A market-structure law: which digital assets are securities and which are commodities, the CFTC as spot-market regulator, the SEC's boundary, registration paths for exchanges and brokers, and treatment of DeFi and developers. It was the second leg of the 2025 stablecoin law. Without it, the agencies keep rulemaking — the SEC's Regulation Crypto Assets proposal, tokenized-securities rules at both agencies — but Chair Atkins conceded these "won't be durable without a law underpinning them", which is the honest description of the regulatory gap: usable, revocable.

Two failures that score the same

  1. Short on votes. The coalition holds; the fix is arithmetic; the market re-opens within weeks. Probability should recover quickly.
